These Terms of Use govern your access to and use of portcroft.com, including the Portcroft Assistant (together, the "Site"), operated by Portcroft Ltd, a company registered in England and Wales under company number 17383266, whose registered office is at Bartle House, 9 Oxford Court, Manchester, M2 3WQ ("Portcroft", "we", "us", "our"). By using the Site you accept these Terms. If you do not accept them, please do not use the Site.

These Terms apply to anyone accessing or using the Site. They are separate from, and do not form part of, the terms on which Portcroft provides consultancy services to its clients. Those services are supplied only under a signed engagement, as described below.

The Site Provides General Information Only

The content of this Site is published for general information about procurement and about the services Portcroft offers. It is not advice, and it is not a substitute for advice given on the facts of a particular situation. Nothing on this Site should be relied upon in making a commercial, contractual, financial, legal or operational decision.

Articles published under Insights are drafted with model assistance from the public source named on each article, then read and approved by a person before publication.

Procurement outcomes depend on circumstances specific to each business, including its data, its suppliers and the market it operates in. Any figure, benchmark, percentage or example described on this Site reflects work carried out in particular circumstances and is not a prediction or indication of what any other business would achieve.

The Portcroft Assistant

The assistant generates its answers automatically, without human review. They may be incomplete, out of date or wrong, are general in nature, and do not constitute advice of any kind. Using the assistant creates no client, advisory or professional relationship and gives rise to no duty of care on Portcroft's part. Do not rely on it when making a decision, and do not enter confidential or commercially sensitive information into it, including supplier pricing, contract terms, spend data or personal data about individuals. It is not a confidential channel. Contact details you enter in the fields offered for a reply are not part of the conversation and are not sent to the artificial intelligence provider.

Portcroft may change, suspend or withdraw the assistant at any time.

Portcroft Insights

Articles published on this Site, and any newsletter issued to subscribers, are commentary of a general nature. They are not advice, are not tailored to your circumstances, and should not be relied upon in making a decision. You may unsubscribe from the newsletter at any time using the link in every email.

Enquiries Do Not Create an Engagement

Contacting Portcroft, whether through the contact form, by email, through the assistant or otherwise, does not create a contract and does not oblige Portcroft to provide any service. Any proposal or fee estimate Portcroft issues is an indication rather than an offer capable of acceptance. Portcroft provides services only once its Terms and Conditions and a Statement of Work have been agreed and signed by both parties.

Intellectual Property

All content on this Site, including text, layout, graphics, the Portcroft name and wordmark, and the descriptions of Portcroft's methods and services, belongs to Portcroft or is used under licence. You may view this Site and print or download extracts for your own internal reference. You may not otherwise copy, republish, distribute or commercially exploit any part of it without our written consent.

You may not extract content from this Site by automated means, scrape it systematically, or use it to train, fine-tune or evaluate any machine learning or artificial intelligence system. You may not use the assistant to build, improve or benchmark a competing product or service.

Acceptable Use

You agree not to use the Site unlawfully, to attempt to gain unauthorised access to it or to any system connected to it, to introduce malicious code, to place unreasonable load on it, or to interfere with anyone else's use of it. We may restrict or withdraw access where we reasonably consider use of the Site to be improper.

Availability

The Site is provided free of charge and on an "as available" basis. We do not warrant that it will be available uninterrupted, that it will be free from error, or that any defect will be corrected. We may change, suspend or withdraw all or part of it at any time.

Links to Other Sites

Where this Site links to a third-party website, that link is provided for convenience. We have no control over the content of any external site and accept no responsibility for it.

Liability

To the fullest extent permitted by law, Portcroft accepts no liability for any loss or damage arising from your use of this Site, from your reliance on anything published on it, or from your reliance on any response generated by the Portcroft Assistant. This includes loss of profit, loss of business, loss of anticipated savings, business interruption and any indirect or consequential loss.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. Nothing in these Terms affects any statutory right you may have that cannot be waived.

Where Portcroft is engaged to provide consultancy services, the liability position between Portcroft and its client is governed by the signed Terms and Conditions for that engagement, not by this page.

Privacy

How Portcroft handles personal data in connection with this Site, including data entered into the assistant and submitted through the contact form, is set out in our Privacy Policy.

Strategy Papers

These terms apply to strategy papers bought from 30 September 2026 (terms version strategy-2026-09-30).

Acceptance occurs on fulfilment, not on payment. Payment is an offer; Portcroft may decline it and refund in full, including where billing is outside the United Kingdom.

Changes to these Terms

We may revise these Terms from time to time. Any revision takes effect when published on this page and will be reflected in the "Last updated" date above. Please check this page when you return to the Site.

Governing Law

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, including non-contractual disputes or claims, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, save that this does not deprive a consumer of the protection of the mandatory rules of the law of their country of residence.
